Working Instructions on Notice on Further Easing Criteria for Rent Payment Oriented HPF Withdrawal in this Municipality (Trial Implementation)

 

 The Working Instructions has been formulated in a move to implement Notice on Further Easing Criteria for Rent Payment Oriented HPF Withdrawal in this Municipality [SHGJJG No. 3 (2015)].

  1. Withdrawal eligibility and criteria

   Provided that the employee (hereinafter referred to as the “applicant”) has rented a home and meet the following requirements:

   (1) The applicant has made at least three consecutive months’ housing provident fund payment;

   (2) Neither the applicant nor the spouse has self-owned or rental housing in this Municipality;

   (3) Neither the applicant nor the spouse has any outstanding housing provident fund loan, or any contractual withdrawal entrustment such as housing provident fund withdrawal due to home loan repayment;

   (4) The applicant and the spouse are allowed to withdraw housing provident fund for rent payment for only one suite;

   (5) The tenancy of the applicant and the spouse should comply with the regulations pertaining to rental property in this Municipality.

 The above-mentioned “rental housing” under item (2) refers to the public rental housing authenticated by the municipal government (including previous low-rent housing and previous public rental housing), or tenancy of any other type of housing in this Municipality (including commercial residential housing, publicly-owned housing, after-sale public housing and entity-provided housing). Any withdrawal involving the housing provident fund account of the applicant’s spouse shall also comply with Notice on Further Easing Criteria for Rent Payment Oriented HPF Withdrawal in this Municipality and relevant stipulations pertaining to the applicant in the Working Instructions.  

2. Withdrawal Amount

  (1) As for tenancy of public rental housing in this Municipality, the monthly withdrawal amount per family must not exceed the actual rent payment for the month or the balance of the applicant’s housing provident fund savings acount (the balance must be kept above one RMB fen).

   (2) As for tenancy of any other type fo housing in this Municipality, the monthly withdrawal amount, capped at 2000 yuan, must not exceed the actual rent payment for the month or the balance of the applicant’s housing provident fund savings acount (the balance must be kept above one RMB fen).

   (3) The withdrawal amount each time must not exceed the limit set for three months.

3. Documents needed for application

   (1) Individuals’ Handling

   The applicant should prepare the following documents (originals and duplicates) for withdrawal application:

   1) proof of the applicant’s identity;

   2) proofs of marriage relationship such as the applicant’s marriage certificate and residence booklet where applicable;

   3) debit card from a bank in this Municipality under the name of the applicant;

   4) Application Form for HPF Withdrawal due to Rent Payment (for individuals) (see Appendix 1), completed and ready;

   5) additionally, as for tenancy of any other type of housing in this Municipality:

   a) previous low-rent housing: i) Housing Lease Contract (A subsidized lessee should also provide Low-Rent Housing Subsidy Agreement issued by the housing security department of this Municipality), ii) rent payment receipt.

   b) previous public rental housing: i) Shanghai Public Rental Housing Lease Contract, ii) tax control invoice indicating that rent has already been paid.

  6) As for tenancy of any other type of housing in this Municipality, the lessee should also provide the completed Application Form for Property Status Information Query (see Appendix 3) or valid proof of no housing (either self-owned or rented).

   (2) Entities’ centralized handling

   Provided that the entity offers residences such as dormitories or talent apartments, or the employee entrusts the entity as proxy for withdrawal processing, the entity may proceed with centralized withdrawal handling procedures for the employee by presenting the documents (originals and duplicates) as follows:

   1) Documents needed for eligibility application

   a) Preliminary Application Form for an Entity’s Centralized Handling of HPF Withdrawal due to Rent Payment (see Appendix 4), completed and confirmed by affixing of the entity’s official stamp;

   b) the entity’s business license, organization code certificate;

   c) a duplicate of the identity card of the entity’s legal person representative;

   d) the identity card of the entity’s handler.

   2) Documents needed for centralized withdrawal processing

   The entity should gather employees’ application materials [refer to the above (1) under item 3 of the Working Instructions, i.e. Documents needed for application\Individuals’ Handling, for submission in wake of conducting preliminary review and filing copies as necessary;

   a) A Breakdown of HPF Withdrawals due to Rent Payment for the Entity’s Centralized Handling, completed and confirmed by affixing of the entity’s official stamp, together with the corresponding electronic files (see Appendix 5); 

   b) Application Form for HPF Withdrawal due to Rent Payment (for entity use) (see Appendix 2), completed and signed by the employee(s).

   4. Withdrawal Time and Means

   Application for housing provident fund withdrawal due to rent payment should be submitted within the contractual housing lease period, and no later than six months after the termination of the tenancy. Account transfer should be adopted as the method.

   5. Withdrawal procedures

   (1) Individuals’ Handling Process

   Eligible applicants should proceed as follows:

   1) An applicant shall submit application to the district/county management division of SPFMC (hereinafter referred to as the district/county management division) at the location of the rental housing, together with relevant documents as required. A voluntary paying employee shall submit application to the district/county management division at the location of the housing provident fund personal account, together with relevant documents as required.

    2) Provided that the applicant has submitted a complete set of documents, the district/county management division shall validate the applicant’s property status as per the regulations, and notify the applicant of the system review result regarding the withdrawal eligibility within three working days (excluding the time needed for validation of the applicant’s property status) from the date of application handling by the district/county management division. Given that any doubt arises in the course of the review of the applicant’s documents, the applicant may be required to provide further valid proofs.

   3) Under the circumstance that the applicant’s withdrawal application is approved,

   a) As for a withdrawal application accepted and handled within the first half of a month, the first withdrawal shall be automatically transferred from the applicant’s housing provident fund account to the applicant’s designated bank debit card in this Municipality prior to the end of the same month; as for a withdrawal application handled in the second half of a month, the first withdrawal shall be automatically transferred to the applicant’s designated bank debit card prior to end of the next month. During the withdrawal grace period granted to the applicant (one year at the most), the withdrawal shall be automatically processed and transferred to the applicant’s designated bank debit card by SPFMC prior to the end of the month on a quarterly basis in wake of approval.

b) In the course of processing, the withdrawal transfer shall be suspended given that the balance of the applicant’s housing provident fund savings account is not sufficient. A supplementary withdrawal shall be automatically processed by the district/county management division in the next month, and the withdrawal transfer shall be carried out given that the supplementary withdrawal is successfully completed. However, the supplementary withdrawal process shall be conducted a second time in the following month if the balance of the account is still inadequate. The withdrawal transfer shall be terminated if the process indicates inadequate balance again.

(2) Entities’ Handling Process

As for entities’ handling process, the same rule applies. Moreover, district/county management divisions shall regularly conduct sample checking of employees’ application documents submitted by the entities, and disqualify those entities having failed in the sampling inspection for preliminary review.

  6. Implementation

   (1) The Working Instructions shall be effective as of 1 May 2015.

   (2) As for tenancy occurred after 1 January 2015 and prior to 1 May 2015, pertinent withdrawals shall be handled by reference to this Working Instructions given that they meet the criteria specified in this Working Instructions and haven’t been processed.
